GeneticDetoxification does not offer medical advice and does not and should not be used to treat, diagnose or cure any conditions.  Any content accessed through GeneticDetoxification is for informational and educational purposes only. GeneticDetoxification has the right to delete your GeneticDetoxification Report twelve months after the date of the generation of such GeneticDetoxification Report.

User Representations

By accessing the GeneticDetoxification Website, you acknowledge and represent and warrant to the Company that:

• You understand that information you learn from GeneticDetoxification is not designed to independently diagnose, prevent, or treat any condition or disease or to ascertain the state of your health.
• You understand that the GeneticDetoxification Services are intended for research, informational, and educational purposes only.
• You acknowledge that GeneticDetoxification urges you to seek the advice of your physician or other health care provider if you have questions or concerns arising from your genetic information.
• You warrant that you are not an insurance company or an employer attempting to obtain information about an insured person or an employee.

Prerequisites to Registration

This Website is offered and available to users who are 18 years of age or older, or the legal age of majority in your state, whichever is greater, and reside in the United States or any of its territories.  You must provide an anonymized identifier in the “Anonymous Identifier” field.  You are responsible for keeping track of your anonymous identifier, and the GeneticDetoxification Report that will correspond with such anonymous identifier.

By establishing or registering for an account on this Website, you acknowledge and represent and warrant to the Company that:

• You are of legal age in your state to form a binding contract with the Company.
• You are a resident of the United States or its territories.
• You are using an anonymised identifier in the “Anonymous Identifier” field for privacy protection.
• If you are uploading someone else’s information, you have received the permission of that person to do so.
• If you are healthcare provider submitting patient data, you are not associating the patient data with a person’s name or any other information classified as PHI (protected health information) under HIPAA.
• You are aware that some of the information you receive may provoke strong emotion.
• You take responsibility for all possible consequences resulting from your sharing with others access to your genetic information and your GeneticDetoxification Report.
• You understand that all your personal information will be stored in GeneticDetoxification databases and will be processed in accordance with the GeneticDetoxification Privacy Policy (https://geneticdetoxification.com/privacy-policy/).
• The information you have provided is accurate and complete, and you have the right and are authorized to provide such information.
• You will update such information from time to time as necessary to keep your registration information current and accurate.

You agree that you have the authority, under the laws of the state or jurisdiction in which you reside, to provide these representations. In case of breach of any one of these representations GeneticDetoxification has the right to suspend or terminate your account and refuse any and all current or future use of the Services (or any portion thereof).

Reliance on Information Posted  

The information presented on or through the Website is made available solely for general information and educational purposes.  We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk.  We disclaim all liability and responsibility arising from any reliance placed on such materials by you or by anyone who may be informed of any of its contents.

Risks and Considerations Regarding GeneticDetoxification and the Services

Once you obtain your genetic information, the knowledge is irrevocable.  You should not assume that any information we may be able to provide to you, whether now or as genetic research advances, will be welcome or positive.  Unwelcome or negative findings will not be easily forgotten and have the potential to significantly impact your life.  You should also understand that as research advances, in order for you to assess the meaning of your DNA in the context of such advances, you may need to obtain further services from your physician, a genetic counselor, or other health care provider.

Some people feel a little anxious about getting genetic health results.  This is normal. If you feel very anxious, you should speak to your physician or a genetic counselor prior to ordering a GeneticDetoxification Report.  

You may learn information about yourself that you do not anticipate.  This information may evoke strong emotions and has the potential to alter your life and worldview.  You may discover things about yourself that trouble you and that you may not have the ability to control or change (e.g., someone with your genotype may have a higher than average chance of developing a specific condition or disease).

You should not change your health behaviors solely on the basis of information from GeneticDetoxification.  Make sure to discuss your genetic information with a physician or other health care provider before you act upon the genetic information from your GeneticDetoxification Report.  For most common diseases, the genes we know about are only responsible for a small fraction of the risk.  There may be unknown genes, environmental factors, or lifestyle choices that are far more important predictors.  If your data indicates that you are not at elevated genetic risk for a particular disease or condition, you should not assume that you are necessarily protected.  The opposite is also true; if your data indicates you are at an elevated genetic risk for a particular disease or condition, it does not mean you will definitively develop the disease or condition.  In either case, if you have concerns or questions about what you learn through GeneticDetoxification, you should contact your physician or other health care provider.

Genetic research is not comprehensive.  While there are many hundreds of thousands of data points from your DNA, only a small percentage of them are known to be related to human traits or health conditions. The research community is rapidly learning more about genetics.  In addition, many ethnic groups are not included in genetic studies.  Because interpretations provided in our service rely on these published studies, some interpretations may not apply to you.  Future scientific research may change the interpretation of your DNA. In the future, the scientific community may show previous research to be incomplete or inaccurate.

Genetic information you share with others could be used against your interests.  You should be careful about sharing your genetic information with others.  Currently, very few businesses or insurance companies request genetic information, but this could change in the future.  While the Genetic Information Nondiscrimination Act (“GINA”) was signed into law in the United States in 2008, its protection against discrimination by employers and health insurance companies for employment and coverage issues has not been clearly established.  In addition, GINA does not cover life, long-term care, or disability insurance providers.  Some, but not all, states and other jurisdictions have laws that protect individuals with regard to their genetic information.  You may want to consult a lawyer to understand the extent of legal protection of your genetic information before you share it with anyone.  Furthermore, genetic information that you choose to share with your physician or other health care provider may become part of your medical record and through that route be accessible to other health care providers and/or insurance companies in the future.  Genetic information that you share with family, friends or employers might be used against your best interests. Even if you share genetic information that has no or limited meaning today, that information could have greater meaning in the future as new discoveries are made.  If you are asked by an insurance company whether you have learned genetic information about health conditions and you do not disclose this to them, this may be considered to be fraud.

The Late-onset Alzheimer’s disease genetic health risk will be included in your GeneticDetoxification Report The Late-onset Alzheimer’s Disease genetic health risk report is indicated for reporting of the ε4 variant in the APOE gene and describes if a person has a variant associated with an increased risk of developing late-onset Alzheimer’s disease.

We reserve the right to withdraw this Website and any Services in our sole discretion without notice.  We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. Online Purchases

All purchases of Products through our Website are governed by these Terms of Use.  You agree that your order of a Product is an offer to buy each Product listed in your order pursuant to these Terms of Use.  All orders must be accepted by us or we will not be obligated to sell the Products to you.  We may choose not to accept any orders in our sole discretion.  After having received your order, we will send you a confirmation email with your order number and details of the Products you have ordered.  Acceptance of your order and the formation of a contract of sale between GeneticDetoxification and you will not take place unless and until you have received your order confirmation email.  

All prices posted on the Website are subject to change without notice.  The price charged for a Product will be the price in effect at the time the order is placed and will be set out in your order confirmation email.  Posted prices do not include taxes or charges for shipping and handling.  All such taxes and charges will be added to your merchandise total and will be itemized in your shopping cart and in your confirmation email.

Terms of payment are within our sole discretion and payment must be received by us before our acceptance of an order.  You represent and warrant that (i) the credit card information you supply to us is true, correct and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by the credit card company, and (iv) you will pay charges incurred by you at the posted prices, including all applicable taxes and charges for shipping and handling.

Title and risk of loss pass to you upon transfer of the products to the carrier for delivery.  Shipping and delivery dates are estimates only and cannot be guaranteed.  We are not liable for any delays in shipments.  

Except for Products designated on the Website as non-returnable, we accept a return of a Product for a refund of your purchase price, less the original shipping and handling costs, provided such return is made within 30 days of shipment and provided such each Product is returned in its original condition.

You are responsible for all shipping and handling charges on retuned items.  You bear the risk of loss during shipment.  Refunds are processed within approximately 30 business days of our receipt of your merchandise.  Your refund will be credited back to the same payment method used to make the original purchase on the Website.  WE OFFER NO REFUNDS FOR PRODUCTS DESINGATED ON THIS WEBSITE AS NON-RETURNABLE.

Geographic Restrictions

The owner of the Website is based in the United States.  We provide this Website for use only by persons resident in the United States.  We make no claims that the Website or any of its content is accessible or appropriate for persons resident outside of the United States.  Access to and registration on this Website may not be legal by certain persons resident in certain countries.  You may not access this Website if you are resident outside the United States.

Limitation on Liability
